Variation Application Types
The ‘Variation’ application types are where a planning decision has been issued by Council, but there is a need to change, alter, vary or extend it in some way.
Change or Cancel Land Use Consent Condition – s127 RMA
Use this application type if you have a land use consent decision issued by Council and you require a change or cancellation to one or more conditions of that land use consent. Example: A change to the site plan layout approved as part of the consent decision
Change or Cancel Subdivision Consent Condition – s127 RMA
Use this application type if you have a subdivision consent decision issued by Council and you require a change or cancellation to one or more conditions of that subdivision consent. Example: A change to the lot boundary locations approved as part of the consent decision
Change or Cancel a Combined Land Use and Subdivision Consent Condition – s127 RMA
Use this application type if you have a combined land use and subdivision consent decision issued by Council and you require a change or cancellation to one or more conditions of that combined consent.
Extension of Time Land Use – s125 RMA
Use this application type if you have a land use consent decision issued by Council and you have not yet commenced the activity, but the timeframe in which to give effect to the consent is running out. Example: Additional time to construct and establish a business activity
Extension of Time Subdivision – s125 RMA
Use this application type if you have a subdivision consent decision issued by Council and you have not yet commenced the activity, but the timeframe in which to give effect to the consent is running out. Example: Additional time is required to lodge the s223 certification to Council.
Consent Notice cancellation or variation – s221(3) RMA
Use this application type if you have a consent notice certificate registered on a record of title and you would like to change or cancel the wording of the consent notice. Example: Building plans drawn to locate an implement shed where a consent notice has been registered on the record of title to restrict the location where buildings can be sited.
Alteration of Designation - s181 RMA
Use this application type if you need to make changes to a notice of requirement for a site designated for a purpose within the District Plan. Example: Additional land is required for a new road interchange
Amalgamation Condition Cancellation - s241 RMA
Use this application type if you have an amalgamation interest registered on your record of title pursuant to s241 of the RMA, and you would like to cancel the requirement for land to be held together. Example: A previous subdivision consent required land to be held together through an amalgamation condition registered on the title, and now it’s preferable to have the land in separate titles.
